A facility raising swine with the following parameters: Swine are confined, fed, and maintained for at least 45 days in any 12-month period. Crops, vegetation, forage growth, or post-harvest residues are not sustained in the normal growing season over any portion of the lot or facility. 3,000 or more swine under 55 pounds are present, and the facility discharges or “proposes to discharge” manure, litter, or process wastewater. “Proposes to discharge” means that the facility is designed, constructed, operated, or maintained, such that a discharge to surface waters of the State WILL occur. Facilities that are under this limit may have been designated by the MDE or EPA to register or may have registered voluntarily. No hog MAFOs exist in Maryland.
